SB1 resident visa is for a US green card holder returning to the US from a visit abroad of more than one year due to emergency or extraordinary circumstances that prevented the green card holder from being able to travel back to the US within 1 year.

Green card holders who are unable to return to the US within the travel validity period of their green card (more than 1 year), or their reentry permit (more than 2 years) may apply for a special immigrant Returning Resident SB1 resident visa.

To qualify as a returning resident, you must prove the following:

 

  • You were a lawful permanent resident when you departed the United States;

  • When you departed you intended to return to the USA and have maintained this intent;

  • You are returning from a temporary visit abroad and if the stay was protracted, it was caused by reasons beyond your control and for which you were not responsible; and

  • You are eligible for the immigrant visa in all other respects.

 

SB1 resident visa applications normally take 2 - 4 months or more to process depending on the caseload of US Embassy in the country of residence.
